terms of use
the deal between you and the warehouse
// 1. what this is
crack head beats is a free, always-on, computer-generated acid techno radio with a community wall, chat and track uploads, operated by noisetrance from the united kingdom. by using the site you agree to these terms. if you do not agree, do not use the site.
// 2. accounts
- you sign in through google, discord, spotify or yahoo. you are responsible for keeping that account secure.
- you must be at least 16 years old.
- one person, one account. do not impersonate others or use a name that is misleading, hateful or infringing.
- we may suspend or delete accounts that break these terms.
// 3. your content
"content" means anything you upload or post: tracks, cover art, titles, comments, chat messages, tags, suggestions and reactions.
- you keep your rights. you own what you upload.
- you give us a licence. by posting you grant noisetrance a non-exclusive, worldwide, royalty-free licence to host, stream, cache, transcode, display and distribute your content on the site and in its feeds, players and share cards, for as long as it stays on the site. you can end the licence by deleting the content.
- you promise it is yours. you must own or have permission for everything in your content, including samples. you are solely responsible for clearing rights.
- other listeners may play, download (where enabled), comment on, blend and share links to your content. do not upload anything you are not happy with that.
// 4. what is not allowed
- content you do not have the rights to, including unlicensed samples and re-uploads of other people's tracks.
- hate speech, harassment, threats, or anything attacking people for who they are. everyone polite is welcome; bigots are not.
- sexual content involving minors, non-consensual intimate imagery, or content that sexualises anyone without consent.
- spam, scams, malware, phishing, or using bots to post, vote or inflate plays.
- doxxing or sharing other people's private information.
- attempting to bypass mutes, time-outs, rate limits or the sign-in wall, or to scrape, attack or overload the service.
// 5. moderation
we can remove any content and mute, time out, wall or ban any visitor at any time, with or without notice, if we believe these terms are at risk. some moderation is automatic: repeated messages, bursts of posting and prolonged silence from signed-out visitors trigger short mutes or time-outs. you can appeal by emailing noisyboiler@googlemail.com.
// 6. copyright complaints
if you believe content on the site infringes your copyright, follow the takedown procedure. repeat infringers lose their accounts.
// 7. donations and paid downloads
donations are gifts and are not refundable. paid downloads are delivered immediately as digital files; under uk consumer law you lose the right to cancel once the download starts, which you agree to at checkout. if a download fails, email us and we will fix it or refund it. payments are processed by stripe under stripe's own terms.
// 8. downloaded music — what you may do with it
generated radio clips (the machine-made stream, snapshots and recordings of it) are licensed to you under creative commons attribution–noncommercial 4.0: you may download, keep, share, remix and perform them for non-commercial purposes if you credit "crack head beats / noisetrance" and link back. commercial use (selling, sync, monetised streams or videos, paid releases) needs written permission from noisetrance.
uploaded tracks belong to the people who uploaded them. a download button means the uploader has allowed you to download the file for personal, non-commercial listening only. you may not re-upload, redistribute, sample, remix, sell or sync an uploaded track without the uploader's own permission, unless the track page states a more permissive licence. the uploader, not noisetrance, is the licensor.
paid downloads and donations buy you the file and our thanks — they do not transfer copyright or grant any commercial rights.
no rights are granted in anything that turns out to be infringing. if we remove a track after a takedown notice, you must stop using any copy you downloaded.
// 9. the radio and the generated audio
the stream is generated by machines in real time and may be strange, repetitive, loud or wrong. it is provided for personal listening. licensing of the clips is described in section 8.
// 10. flashing lights and loud sound
rave mode, the lights and some pages flash. if you are photosensitive, keep those modes off and use the accessibility panel to reduce motion. protect your ears: the stream can be loud.
// 11. no warranty, limited liability
the site is provided "as is", without any warranty. it may go down, lose content or change without notice. to the fullest extent allowed by law, noisetrance is not liable for any loss arising from your use of the site, and in any case our total liability is limited to the amount you paid us in the previous 12 months. nothing here limits liability that cannot be limited under english law.
// 12. ending things
you can stop using the site at any time and ask us to delete your account and content. we can close the site or your account at any time.
// 13. law
these terms are governed by the law of england and wales, and the courts of england and wales have jurisdiction, without affecting consumer rights you have where you live.
// 14. changes
we may update these terms; the "last updated" date moves when we do. continuing to use the site after a change means you accept it.
